General NV Homeschooling Special Needs Info
Homeschooling children with special needs is totally possible.

- A great new national organization (as of August, 2017) now exists to help parents meet the educational needs of their children. But the people behind SPED Homeschool are anything but new to special needs homeschooling community. If you are considering homeschooling a special needs child check out the SPEDHomeschool website for help in starting to homeschool, encouragement in the process, and meeting specific needs of your child. - Homeschooling laws for a special needs child are the same as for any Nevada child. A good reference is the NHN Homeschool MEMO to Parents, Public-Private School Administrators, State Officials 01.11.2019 update.
A homeschooled child may be able to receive special education services from a NV public school. However, NHN warns parents of children never enrolled in a public school to be VERY cautious and think seriously before contacting your local public school for special education services.
Nevada law NRS 392.072 equates a homeschooled child to a private school child for purposes of Nevada and Federal special education laws and regulations. Under these laws, a homeschooled child is not entitled to services that would be provided by a FAPE (Free Appropriate Public Education) and IEP (Individualized Education Plan) offered by the local public school.
However, a homeschool child with special needs may still be entitled to receive services from the public school if the parent wishes to seek them. After a homeschooled child has been identified via the Child Find provisions of IDEA (Individuals with Disabilities Education Act), the local public school district consults with homeschool representatives to determine how the funding allocated to homeschooled students will be distributed. The greater the number of homeschooled children who have been identified, the greater the proportionate amount of funding to be provided to the homeschooled segment.
Unlike a public schooled child, not every homeschooled child is entitled to receive services. For those homeschooled children who do receive services, with final determination by the local district, a service plan is developed (similar to an IEP), and services are provided. Once your child has been evaluated and services deemed necessary, you will go to your locally zoned school for the services (unless they need to point you to a different school for the specific service)
When you go to that school, bring your exemption paperwork. The Registrar will ask you to fill out paperwork. Do not let it scare you. It may say “enrollment” or “registration”, it is not enrolling your child full time. Your child will be participating under an E4 or E5 status. That is a homeschooled or private schooled child receiving SOME service. You can verify with the Registrar, if you like, that your child is being registered as a homeschooled student, as an E4 or E5. They will know the codes. You are still registered as a homeschooler. This is paperwork for the school to receive their funding.
This is a relatively new thing to most schools; as always, be prepared to be the advocate.
As you are requesting participation for your child in a public school special services program, they will ask for immunization records. Please be aware of the law in this area if your family chooses not to vaccinate. The school has no legal right to ask you what your religion is or to question your religious beliefs. For your reference NRS 392.435 and 392.437 are cited below. Also click here, to see a sample non-vaccinating letter (also at the end of this page).
They may also ask to see the child’s birth certificate. As this is no longer presented upon filing our Notice of Intent, it is their right to ask to see it when requesting to participate in public school classes, activities, and sports programs.
Also, you will need to file the required Notice of Intent to Participate in Programs and Activities Form – NOIPPA.NHN 2016.1 with your local school district each. This is required each year your child receives services.
For parents who tried public school for their child but decide later to homeschool them because it is a better choice for the child, the child MAY still be able to receive special education services outlined in the child’s public school IEP… contact Nevada-PEP for help.
NRS 392.072 Participation of homeschooled children and opt-in children in programs of special education and related services; regulations.
1. The board of trustees of each school district shall provide programs of special education and related services for homeschooled children. The programs of special education and related services required by this section must be made available:
(a) Only if a child would otherwise be eligible for participation in programs of special education and related services pursuant to NRS 388.417 to 388.469, inclusive, or NRS 388.5251 to 388.5267, inclusive;
(b) In the same manner that the board of trustees provides, as required by 20 U.S.C. § 1412, for the participation of pupils with disabilities who are enrolled in private schools within the school district voluntarily by their parents or legal guardians; and
(c) In accordance with the same requirements set forth in 20 U.S.C. § 1412 which relate to the participation of pupils with disabilities who are enrolled in private schools within the school district voluntarily by their parents or legal guardians.
2. The programs of special education and related services required by subsection 1 may be offered at a public school or another location that is appropriate.
3. The board of trustees of a school district may, before providing programs of special education and related services to a homeschooled child or opt-in child pursuant to subsection 1, require proof of the identity of the child, including, without limitation, the birth certificate of the child or other documentation sufficient to establish the identity of the child.
4. The Department shall adopt such regulations as are necessary for the boards of trustees of school districts to provide the programs of special education and related services required by subsection 1.
5. As used in this section, “related services” has the meaning ascribed to it in 20 U.S.C. § 1401.

NRS 392.435 Immunization of pupils: Certificate prerequisite to enrollment; conditional enrollment; effect of failure to immunize; report to Health Division; inclusion of certificate in pupil’s record.
1. Unless excused because of religious belief or medical condition, a child may not be enrolled in a public school within this state unless his parents or guardian submit to the board of trustees of the school district in which the child resides or the governing body of the charter school in which the child has been accepted for enrollment a certificate stating that the child has been immunized and has received proper boosters for that immunization or is complying with the schedules established by regulation pursuant to NRS 439.550 for the following diseases:

A public school shall not refuse to enroll a child as a pupil because the child has not been immunized pursuant to NRS 392.435 if the parents or guardian of the child has submitted to the board of trustees of the school district or the governing body of a charter school in which the child has been accepted for enrollment a written statement indicating that their religious belief prohibits immunization of such child or ward.

A group for families in Nevada who homeschool children with special needs. We will support each other and will provide simple playdate outings where our children can be themselves, make friends, and have fun!
Blessings is a Christian-led organization and ministry in Nevada, run by volunteers. Membership is open to Christians and non-Christians alike. This group is not intended to replace any groups that you are in, but to enhance. Organized playdates will be scheduled about once a month.
